2. Purpose

This Legal Notice governs access to, browsing of, and use of the website www.twoblackcatsgames.com (the "Website"), through which the Owner offers software, digital content, development hardware, and physical products related to video games. Access to the Website confers the status of user and implies acceptance of these terms; the purchase of products is additionally governed by the General Terms and Conditions of Sale.

3. Conditions of access and use

The user undertakes to use the Website in accordance with the law, good faith, and public order, refraining from: (i) using the contents for unlawful purposes or purposes harmful to third parties; (ii) introducing or disseminating programs, viruses, or systems that may damage the systems of the Owner or of third parties; and (iii) improperly accessing or manipulating data of the Owner or of other users. The user is responsible for the accuracy of the data they provide.

4. Intellectual and industrial property

The intellectual property rights in the Website (design, structure, source code, texts, and images) and the Owner's own distinctive signs belong to the Owner or to third parties who have authorised their use. Their reproduction, distribution, public communication, or transformation without express authorisation is prohibited.

• Third-party trademarks. The names of third-party consoles or systems (e.g. "Mega Drive / Genesis", "Game Gear", "SNES", "Game Boy Advance") may be used solely for descriptive purposes, to indicate the product's compatibility, in accordance with the limitation on trademark rights set out in Article 37 of Law 17/2001 (Spain's Trademark Act) and Article 14 of Regulation (EU) 2017/1001 (the EU Trade Mark Regulation). Such trademarks belong to their respective owners; the Owner is not affiliated with, associated with, authorised by, or sponsored by them.
• Hardware based on open designs. Where certain products incorporate or are based on designs, documentation, or components subject to open source or open hardware licences, the terms of such licences will be respected and, where applicable, the corresponding authorship, attribution, or licence notices will be included in the product listing, technical documentation, or associated materials; the Owner claims as its own only its own contributions.

5. Liability

The Owner:

1. Will endeavour to ensure that the general information on the Website is correct and up to date, without prejudice to the fact that the characteristics, prices, availability, and conditions applicable to the products shall be governed by the information stated in each product listing and in the General Terms and Conditions of Sale.
2. Does not guarantee the continuous and uninterrupted availability of the Website nor the absence of errors in its contents.
3. Shall not be liable, within the limits permitted by law, for damage arising from improper use of the Website or from the presence of harmful elements beyond its control.
4. Adopts reasonable security measures, although the absolute inviolability of the Internet cannot be guaranteed.

6. Hyperlinks

The Website may contain links to third-party sites, over whose contents, availability, or policies the Owner exercises no control whatsoever, assuming no responsibility for them. The existence of such links does not imply any recommendation of, or relationship with, the linked sites.

7. Commercial communications

In accordance with Article 21 of the LSSI-CE, the Owner will send commercial communications by email or another equivalent electronic means where these have been previously requested or expressly authorised by the recipient, by means of the corresponding voluntary subscription. The user may withdraw such consent at any time, as well as object to receiving such communications, by contacting support at twoblackcatsgames dot com.

8. Electrical and electronic equipment (WEEE / RAEE)

The Owner is registered as a producer of electrical and electronic equipment under number RII-AEE 22468. In accordance with the WEEE (RAEE) regulations, electrical and electronic equipment must not be disposed of together with household waste and may, at the end of its useful life, be handed in at the designated collection points.

9. Data protection

The processing of users' personal data is governed by the Privacy Policy and the Cookie Policy, which are permanently accessible on the Website.

10. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. Where the user has the status of a consumer or user, any dispute shall be submitted to the courts and tribunals that have jurisdiction in accordance with the applicable regulations. Where the user acts as a business or professional, and provided that the applicable regulations so permit, the parties expressly submit to the Courts and Tribunals of León, Spain, expressly waiving any other jurisdiction that might correspond to them.

11. Amendments

The Owner may amend this Legal Notice to adapt it to regulatory, technical, or operational changes, or to changes relating to the content or configuration of the Website. The applicable version shall be the one in force at each moment of access to the Website. Amendments to the Legal Notice shall not, in themselves, affect contracts already concluded, which shall be governed by the terms accepted at the time of purchase, unless a mandatory rule applies or express notice is given otherwise in accordance with the law.
